Advance directives are critically important for capable individuals who wish to avoid the burdens of life-prolonging interventions in the advanced stages of dementia. However, this paper will argue that advance directives should have less application to questions about feeding patients during the clinical course of dementia than often has been presumed. The argument will be framed within the debate between Ronald Dworkin and Rebecca Dresser regarding the moral authority of precedent autonomy to determine an individual’s future end-of-life care plan. We will use a brief analysis of the positions taken in two important papers that come out of the Dworkin/Dresser debate and a hypothetical patient, John, who will be followed from diagnosis of dementia to death, to show how advance directives should apply to key points in the progression of his disease, particularly in relation to food and nutrition. The field of cognitive modeling has progressed beyond modeling cognition in the context of simple laboratory tasks and begun to attack the problem of modeling it in more complex, realistic environments, such as those studied by researchers in the field of human factors. The problems that the cognitive modeling community is tackling focus on modeling certain problems of communication and control that arise when integrating with the external environment factors such as implicit and explicit knowledge, emotion, cognition, and the cognitive (...) system. These problems must be solved in order to produce integrated cognitive models of moderately complex tasks. Architectures of cognition in these tasks focus on the control of a central system, which includes control of the central processor itself, initiation of functional processes, such as visual search and memory retrieval, and harvesting the results of these functional processes. Because the control of the central system is conceptually different from the internal control required by individual functional processes, a complete architecture of cognition must incorporate two types of theories of control: Type 1 theories of the structure, functionality, and operation of the controller, and type 2 theories of the internal control of functional processes, including how and what they communicate to the controller. This book presents the current state of the art for both types of theories, as well as contrasts among current approaches to human-performance models. In «Naturalized Epistemology and the Law of Evidence Revisited», the original target article for the various refutations that I comment on here, I revisited through a slightly different lens the subject of the article that I coauthored with Brian Leiter close to twenty years ago. That article has prompted four responses from Professors Pardo, Spellman, Muffato, and Enoch. Professors Pardo and Spellman basically accept the implications of the original article and offer useful but friendly amendments. Prof. Muffato apparently does not (...) want to dispute over my ground and so changes the subject, and in doing so offers a number of interesting points. Only the fourth, Prof. Enoch, has the same doubts about the utility of my original article as I do of the genre that gave rise to it. I can thus be quite brief in discussing professors Pardo, Spellman, and Muffato, but it will take bit more effort to lay out the limits of Prof. Enoch’s analysis. (shrink)

This book argues that Kant's transcendental idealism has been misinterpreted: it denies not simply the super-sensory reality of space, time, and appearances, but their reality outside imagination as well. After adducing extensive and explicit textual evidence in its favor, Waxman shows this interpretation to be essential to the Transcendental Deduction, the affirmation of things in themselves, and the attempt to surmount Hume's scepticism. He further argues that Kant's much-neglected claim that, besides himself, "no psychologist has so much as even thought (...) that the imagination might be a necessary constituent of perception," should be construed so that even our consciousness of sensation itself (visual, tactile, etc.) is impossible without imagination. A compelling and original contribution to Kantian scholarship, Kant's Model of the Mind will also bear close examination by students and scholars of Hume, the philosophy of mind, and the philosophy of science. This brief essay explores how understanding the treatment of expert evidence requires engaging with its legal and political contexts, and not just focusing on its epistemological aspects. Although the law of evidence and thus its treatment of experts is significantly informed by epistemological considerations, it is also informed by concerns over the organization of trials, larger issues of intelligent governance, social concerns, and enforcement issues. These five aspects to the law of evidence give rise to principles to guide the explicit (...) structuring of the law of evidence that are identified here as well. This complexity helps to explain why the central issue of expert testimony is not the epistemological one of knowledge and belief but instead the conflict between educational and deferential modes of trial. A common methodological adage holds that diverse evidence better confirms a hypothesis than does the same amount of similar evidence. Proponents of Bayesian approaches to scientific reasoning such as Horwich, Howson and Urbach, and Earman claim to offer both a precise rendering of this maxim in probabilistic terms and an explanation of why the maxim should be part of the methodological canon of good science. This paper contends that these claims are mistaken and that, at best, Bayesian accounts of diverse (...) evidence are crucially incomplete. This failure should lend renewed force to a long-neglected global worry about Bayesian approaches. (shrink)

The probabilistic account of juridical proof meets insurmountable problems. A better explanation of juridical proof is that it is a form of inference to the best explanation that involves the comparative plausibility of the parties’ stories. In addition, discrete evidentiary matters such as relevance and probative value are also best understood as involving inference to the best explanation rather than being probabilistic.

The idea that english has more than one declarative "mood" has been dismissed as superstitious by empirically-minded grammarians of english for centuries--with such spectacular unsuccess, however, that the indicative/subjunctive dichotomy stands today as a cornerstone for philosophical and logical speculation about "conditionals." let me be next into the breach. i shall urge that there is no grammatical basis for any such distinction. and as for the particular adjudications of mood logicians and philosophers actually propose, there is neither rhyme nor reason (...) to them. my bent, then, is basically destructive. but i shall also be outlining a better taxonomy. In a recent book, ^[1] Michael Tye has offered a representational theory of phenomenal consciousness. As Tye himself admits, part of his account involves arguing for a position which has traditionally received little support; he contends that _all_ experiences and feelings have representational.

The problem of providing mandated medical care has become commonplace as correctional systems in the United States struggle to manage unprecedented increases in its aging prison population. This study explores older incarcerated women’s perceptions of prison health care policies and their day-to-day survival experiences. Aggregate data obtained from a sample of 327 older women residing in prison facilities in five Southern states were used to identify a baseline of health conditions and needs for this vulnerable group. With an average of (...) 4.2 chronic health conditions, frequently histories of victimization, and high rates of mental health issues, the women’s experiences of negotiating health care was particularly challenging. By incorporating the voices of older women, we expose the contradictions, dilemmas, and obstacles they experience in their attempts to obtain health care. It is clear from the personal accounts shared that, despite court mandates, penal harm practices such as delaying or denying medical treatment as well as occasional staff indifferences are common in women’s prisons. With older women having the greatest need for health care, an age- and gender-sensitive approach is recommended. (shrink)

Hart's "Ascription of Responsibility and Rights" is where we find perhaps the first clear pronouncement of defeasibility and the technical introduction of the term. The paper has been criticised, disavowed, and never quite fully redeemed. Its lurid history is now being used as an excuse for dismissing the importance of defeasibility.

This paper argues that the form of explanation at issue in the hard problem of consciousness is scientifically irrelevant, despite appearances to the contrary. In particular, it is argued that the 'sense of understanding' that plays a critical role in the form of explanation implicated in the hard problem provides neither a necessary nor a sufficient condition on satisfactory scientific explanation. Considerations of the actual tools and methods available to scientists are used to make the case against it being a (...) necessary condition, and work by J.D. Trout that exploits psychological research on the hindsight and overconfidence biases is used to show that it is not a sufficient condition. It is argued, however, that certain intellectual and moral concerns give us good reason to still try to meet the hard problem's explanatory challenge, despite its extrascientific nature. (shrink)

This review essay emphasizes the distinction between academic art history, based ultimately on the model of scientific research, and the sort that Roberto Calasso practices in his 2009 study Tiepolo in Pink. It is difficult to locate the book's genre, and the reviewer rejects identifying it as a biography (of the sort practiced by Irving Stone, Somerset Maugham, and Dimitri Merejkovski), since Calasso, like most other writers on Tiepolo, stresses how little we know about his personality, which was elusive, and (...) about his private life, which was undramatic. What chiefly interests both Calasso and the reviewer is whether Tiepolo, whose ceiling frescoes are without gravity—their “antigravity” draws the painted figures upward—is an artist without gravitas. The reviewer supports Calasso's argument that the thirty-two etchings comprising the Capricci and Scherzi make it absurd to consider Tiepolo artistically, intellectually, or morally frivolous. “Scientific” art historians have applied the category of “decoration” to these somber etchings, with their incomprehensible allegories, but Calasso, himself an artist (a novelist), approaches these pictures without scientific prejudice. The reviewer traces the dour attitude of mainstream art historians toward Tiepolo to his rivalry for commissions in the 1760s with Anton Raphael Mengs, a representative of the rising Enlightenment cult of virtue and the austere aesthetics of a rising neoclassicism. From that time on, art historians have treated Tiepolo's work as unhealthy, lightweight, and bizarre, but this review supports Calasso's claim that his work is actually sober and moving. The review concludes that there are artists whom the narrow sensibility of standard art historians will never be able to accommodate, Tiepolo being only one among several. (shrink)

This article draws on Foucault's concept of governmentality to explore how recent political moves to legalise ‘flexibility’ mobilises education authorities to make ‘community’ a technical means of achieving the political objective of schooling the child. I argue that ‘flexibility’ in this sense is a neo‐liberal strategy that shifts relations between the governed and the State. In this way, it transforms the idea of schooling from a State run institution for the purpose of ‘community building’ to a community run institution for (...) the purpose of making parents governable by both instrumentalising and institutionalising individualism through the force of community membership. Rather than a form of liberation from bureaucratic rule, the paper exposes how ‘flexibility’ acts as a normalising strategy that works with difference to entangle parents as community members in the process of schooling the child through the moral obligation of the contract.
